Green Card Through Self-Petition
My Spouse (Principal Applicant) secured his Green Card (U.S. Lawful Permanent Residency) from USCIS in the “ EB1-EA Extraordinary Ability ” Category through Self-Petition.
According to USCIS
EB1-EA GC applicants must be able to demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim.
EB1-EA (Extraordinary Ability) through Self-Petition is a two-step process:
Labor Certification is not required for EB1A Self-Petition (& EB2-NIW/Self-Petition)
Step 1: I-140 Filing (Being Eligible for Green Card)
Step 2: I-485 (Adjustment of Status-Filing for Green Card)
*I-140 and I-485 Can be filled concurrently or non-concurrently (separately).
Why Self-Petition is preferred over Employer-based Petition in the category of Extraordinary Ability
If you are a Ph.D., Ph.D. student, Postdoc, or even a Master student, you can apply for a U.S. Green Card yourself (Self-Petition) under Extraordinary Ability Criteria (EB1-EA).
- The complete Green Card Process is under your control and not under your Employer or a Lawyer’s control.
- No PERM Labor Certification is essential to file the petition. Acquiring a Labor Certification is a protracted process.
- No Specific Job offer (Employer Sponsorship) is needed to file the case.
- No Attorney assistance is required to deal with your petition. DO- It-Yourself (DIY).
- Saves an awesome sum of money (Thousands of greenback $$$) as in comparison with hiring a Lawyer.
- Faster processing time. Generally Shorter Priority Date Waiting Time.
- As the petition would not rely on the present Employer, it provides you more flexibility and the option to move around different U.S. employers during the entire GC process.
In case you have the right combinations of Education, Skills that prove your Achievements coupled with Evidence, and/or Work experience and are otherwise eligible, you may be able to crack the US Green Card (EBA-EA Criteria) yourself (Do-It-Yourself). The Most significant factor in securing your Green Card is the successful drafting of a formal Cover Letter.
“If the petitioner is qualified for EB1A and EB2-NIW (National Interest Waiver), it may be worthwhile considering to file in both categories, to increase the chance of success for getting the Green Card.”
